New Mexico’s $25B Meta judgment puts AI firms on notice, attorney general says
New Mexico Attorney General Raúl Torrez is warning artificial intelligence companies that his office may take them to court if they mislead consumers about what their products do or how they use personal data. Torrez issued the warning after New Mexico secured a $25 billion judgment against Meta over claims the company misled the public about its privacy protections. The ruling, announced Wednesday, followed the state’s decision to reject an $17 billion multistate settlement with Meta in August and pursue its own case. “Anyone in artificial intelligence, people who are building products that they can’t control, people who are making representations in the marketplace about what a product does or doesn’t do, or how it uses or doesn’t use specific types of consumer data, we are going to be watching, and we are prepared to do this again,” Torrez said in an interview. He added that Silicon Valley should understand “this is not the end, it’s just the beginning.” The Meta case relied on consumer-protection law and allegations about the company’s claims concerning privacy controls. States are also using consumer-protection laws in lawsuits against AI developers, putting companies’ public promises about data handling and product capabilities under growing legal scrutiny. Torrez, a Democrat, discussed the judgment at a news conference in Albuquerque on Wednesday. The case could encourage other states to pursue technology companies in court rather than accept negotiated settlements, though the warning does not mean New Mexico has announced a specific new AI lawsuit.
